General terms and conditions

1. Applicability

These general terms and conditions apply to all legal services provided by Ciriks Law and to all agreements concluded between Ciriks Law and its clients, unless otherwise agreed in writing.

2. Definitions

  • Client: the person or entity that engages Cirikslaw for legal services.
  • Agreement: the contract between Ciriks Law and the client for legal services.
  • Services: all legal services provided by Ciriks Law.

3. Offer and Acceptance

Offers made by Ciriks Law are without obligation unless explicitly stated otherwise. An agreement is formed when Ciriks Law confirms acceptance of the assignment in writing or begins performing the services.

4. Rates and Payment

  1. Fees are charged as agreed, either as an hourly rate, a fixed fee, or a subscription package.
  2. All fees are exclusive of VAT, unless stated otherwise.
  3. Invoices are payable within 14 days of the invoice date, unless agreed differently in writing.
  4. If payment is not received on time, Ciriks Law may charge statutory interest and collection costs.

5. Client Obligations

The client shall:

  • Provide all necessary information and documents required for Ciriks Law to perform the services.
  • Respond promptly to requests from Cirikslaw.
  • Cooperate fully in the execution of the services.

6. Confidentiality

Ciriks Law will treat all information obtained from the client as confidential, in accordance with professional secrecy and GDPR requirements.

7. Liability

  1. Ciriks Law is liable only for direct damages caused by gross negligence or intentional acts.
  2. Indirect damages, including lost profits, missed opportunities, or consequential damages, are explicitly excluded.
  3. Liability is limited to the amount paid for the specific service or, if applicable, the last 12 months of fees charged for the service.

8. Termination

Both parties may terminate the agreement with written notice. Any fees due for services already provided remain payable.

9. Governing Law and Jurisdiction

Dutch law applies to all agreements with Ciriks Law. Any disputes arising from these agreements will be submitted to the competent court in the Netherlands.

10. Amendments

Ciriks Law reserves the right to amend these general terms and conditions. Changes will be communicated in writing or published on the website.
